How We Help — The Emptying Nesters

• We will want to help Jennifer and Michael maintain an appropriate amount of control to carry out their wishes: they will likely need several trusts.
• To prevent an accidental disinheritance of the children from a prior relationship, they should use trusts to control how property is divided after the death of the surviving spouse and prevent an accidental disinheritance (survivor gives property to “my children” and disinherits the prior child of the first spouse to die).
• They should also strongly consider lifelong trusts to protect a child's inheritance from their creditors.
